REGULATIONS

I. GENERAL PROVISIONS

  1. The entrepreneur running the online store located at the internet domain www.art-apartamenty.pl, hereinafter referred to as the “Online Store”, is Barbara Fabiś conducting business under the name ART APARTAMENTY Barbara Fabiś, 48b/1 Wroclawska Street, 65-218 Zielona Gora, having NIP No. 973-075-60-92, hereinafter referred to as the Lessor.
  2. On the Online Store, Buyers may make reservations for apartments for rent (“Services”), under the terms and conditions set forth in these Terms and Conditions.
  3. The condition for using the Services in the Online Store is acceptance of the provisions of these Regulations and placing an order.
  4. Rental agreements can be concluded both using the reservation form provided by the Lessor, as well as by telephone.
  5. Contact with the Online Store is possible via e-mail: kontakt@art-apartamenty.pl, by phone from Monday to Friday from 9:00 a.m. to 6:00 p.m., at telephone number: +48 606 715 640 and via the contact form located on the website: https://art-apartamenty.pl/de/kontakt/.
  6. Whenever working days are referred to in the Regulations, they shall be understood as days from Monday to Friday, with the exception of public holidays in Poland.
  7. These Regulations apply to apartment reservations by Consumers, i.e. individuals entering into apartment rental agreements not directly related to their business or professional activities.

II. CONCLUSION OF LEASE AGREEMENTS

  1. Placement of a specific apartment on the website of the Online Store along with the indication of its price does not constitute an offer to rent it, but only an invitation to Buyers to conclude a Contract.
  2. The reservation is submitted to the Lessor by the Buyer in electronic form and constitutes an offer to conclude a rental agreement for the apartment placed on the Web Store website for the price specified therein. An offer made in electronic form is binding on the Buyer if the Lessor immediately acknowledges its receipt.
  3. In order to use the Online Store and make reservations, it is necessary to connect to the Internet and have an e-mail account.
  4. The Online Store operates 24 hours a day, which means that the Buyer can make reservations at any time by accessing the Store’s website and performing the actions indicated later in this Section.
  5. Reservations are made subject to the availability of the apartments on a given date. In case of unavailability of the apartments included in the reservation, the Consumer is informed about the status of the reservation and decides on the method of its realization (rescheduling, cancellation).
  6. In order to make a reservation, the buyer selects an apartment on the website www.art-apartamenty.pl, and then provides data: name, surname, address (city, street, house number, apartment number, postal code), e-mail address, telephone number (optional). The buyer makes a choice of payment method: bank transfer (payment to the Lessor’s bank account) or payment on the spot when picking up the keys.
  7. The Lessor provides the Buyer with the opportunity to correct any errors in the reservation submitted, to change or cancel it until the conclusion of the rental agreement, i.e. confirmation by the Lessor of acceptance of the reservation for execution.
  8. The lessor confirms receipt of the reservation by an e-mail message, which he sends to the buyer. The message, which constitutes the rental agreement, includes, in particular: the reservation number and date, the details of the selected apartment, the price and the method of its payment, the details of the contracting parties, the rental term.
  9. If the proposed content of the rental agreement is not consistent with the reservation made by the Buyer, the Buyer should notify the Lessor without undue delay by sending an email indicating the discrepancies noted. The Lessor will send the Buyer the corrected content of the proposed agreement without undue delay. Rental agreements are concluded in the Polish language. The content of rental agreements is each time recorded and secured in accordance with the mandatory provisions of law.

III. RULES FOR PAYMENT OF THE PRICE

  1. Prices for apartment rentals in the Online Store are gross, including all taxes.

  2. The buyer may choose the following forms of payment: a) Bank transfer – payment directly to the Lessor’s bank account. Payment should be made after confirmation of receipt of the reservation by the Lessor. The reservation will be confirmed after the payment is credited to the Lessor’s account. Transfer details:

    (b) Payment on the spot – payment when receiving the keys to the apartment.

IV. RENTAL SERVICE

  1. Rental service refers to the rental of apartments for the period specified by the Lessor, in accordance with the reservation made by the Buyer.
  2. The apartments shall be made available to the Buyer in accordance with the rental term specified in the rental agreement.
  3. Collection of keys to the apartment takes place at the place agreed with the Lessor, on the rental date.
  4. The landlord does not make courier deliveries of products, as the offer is for the rental of premises, not for the delivery of physical goods.
  5. The buyer is obliged to return the apartment in an undamaged condition, taking into account normal wear and tear resulting from use.

V. RIGHT OF WITHDRAWAL

  1. The consumer is entitled to withdraw from the apartment rental contract without stating a reason, under the terms and conditions set forth below (procedure under Chapter 4 “Right of withdrawal” of the Consumer Rights Act of May 30, 2014).

  2. The deadline for withdrawal from the apartment rental agreement expires 14 days after the date of the rental agreement.

  3. In order to exercise the right to withdraw from the apartment rental agreement, the Consumer should inform the Landlord of his/her decision by an unequivocal statement of intent in one of the following ways: a) Sending an e-mail to kontakt@art-apartamenty.pl b) Sending a letter to the address: ART APARTMENTS Barbara Fabiś, Wrocławska Street 48b/1, 65-427 Zielona Góra.

    If the statement of withdrawal is sent electronically (via e-mail), the Lessor will immediately send the Buyer an acknowledgement of receipt of the statement of withdrawal.

  4. In the event of withdrawal from the Rental Agreement, the Lessor shall reimburse the Buyer for the rental costs of the apartment no later than 14 days from the day on which the Online Store was informed of the Buyer’s decision to exercise the right to withdraw from the contract.

VI. EXCHANGES AND COMPLAINTS

  1. The rental service is not exchangeable for another, however, the Buyer may change the rental date of the apartment, if the Lessor agrees.
  2. Complaints regarding apartment rental services should be submitted in writing to the Landlord’s address or by email to kontakt@art-apartamenty.pl.
